BM ISP Terms and Conditions Effective Date: 2025
1. Introduction
Welcome to BM ISP. These Terms and Conditions (“Terms”) govern your use of the internet services (“Service”) provided by BM ISP (“we,” “us,” “our”). This document constitutes a legally binding agreement between you, the customer (“you,” “your,” “Subscriber”), and BM ISP.
By subscribing to, activating, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Definitions
Service: Internet access and related services provided by BM ISP.
Subscriber/Customer: The individual or entity who subscribes to the Service.
Equipment: Any hardware provided by BM ISP to deliver the Service, such as an Optical Network Unit (ONU), router, or cabling.
AUP: Acceptable Use Policy, which outlines prohibited uses of our Service.
3. Service Provision
Service Speed: All service plans are advertised with “up to” speeds, which represent the maximum possible speed. Actual speeds may vary based on network congestion, server location, your device’s capabilities, and other factors. We do not guarantee uninterrupted or error-free service.
Fair Usage Policy (FUP): To ensure equitable access for all subscribers, certain packages may be subject to a Fair Usage Policy. If your data consumption is deemed excessive and negatively impacts the network, we reserve the right to manage your connection speed.
Maintenance: We may temporarily suspend the Service for scheduled or emergency maintenance. We will provide advance notice for scheduled maintenance whenever possible.
4. Subscriber Responsibilities
As a subscriber, you agree to:
Provide accurate and complete personal and billing information and update it as necessary.
Ensure the security of your account, including your password and any connected devices.
Use the Service in compliance with all applicable laws of Bangladesh and this AUP.
Be responsible for all activity that occurs on your account, whether authorized by you or not.
5. Acceptable Use Policy (AUP)
You are prohibited from using the Service for any unlawful, abusive, or fraudulent purpose. Prohibited activities include, but are not limited to:
Illegal Activities: Engaging in any activity that violates local, national, or international law. This includes transmitting copyrighted material without permission.
Spamming: Sending unsolicited bulk emails or messages.
Hacking and Security Violations: Attempting to gain unauthorized access to any computer, network, or data.
Disruption of Service: Engaging in any activity that disrupts or interferes with our network or the ability of others to use the Service.
Harmful Content: Transmitting any material that is threatening, abusive, defamatory, or obscene.
Reselling: Reselling the Service or sharing your connection with individuals outside your household/premises without our express written permission.
Violation of the AUP may result in immediate suspension or termination of your Service without notice.
6. Billing and Payment
Billing Cycle: The Service is provided on a prepaid monthly basis. You are required to pay your subscription fee in advance of each billing cycle.
Payment Due Date: Payment must be made on or before the due date specified on your invoice to avoid service interruption.
Payment Methods: We accept payments via cash, bank transfer, and Mobile Financial Services (MFS) such as bKash, Nagad, and Rocket.
Late Fees and Suspension: Failure to make payment by the due date may result in a late fee and/or the temporary suspension of your Service. To reactivate a suspended account, all outstanding dues must be cleared.
No Refunds: All payments are non-refundable.
7. Equipment
Ownership: All Equipment provided by BM ISP remains our property.
Responsibility for Care: You are responsible for keeping the Equipment safe from damage, loss, or theft. In the event of damage or loss due to your negligence, you will be liable for the cost of repair or replacement.
Return of Equipment: Upon termination of your Service, you must return all Equipment to us in good working condition. Failure to do so within 15 days of service termination will result in you being charged the full replacement cost of the Equipment.
8. Suspension and Termination
Termination by Subscriber: You may terminate your Service at any time by providing us with 30 days’ written notice. You will be responsible for all charges until the end of the notice period.
Termination by BM ISP: We reserve the right to suspend or terminate your Service, without notice, for any of the following reasons:
Failure to pay your bill on time.
Violation of these Terms or the AUP.
Providing false or inaccurate information.
Engaging in fraudulent or illegal activities.
9. Limitation of Liability
BM ISP shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of or inability to use the Service. This includes but is not limited to, damages for loss of data, loss of profits, or business interruption. Our total liability to you for any claim arising from this agreement shall not exceed the amount of one (1) month’s subscription fee.
10. Disclaimer of Warranties
The Service is provided on an “AS-IS” and “AS-AVAILABLE” basis. We make no warranties, express or implied, regarding the Service, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.
11. Modification of Terms
We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on our website (www.bmisp.net) and will become effective immediately. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed following the laws of Bangladesh. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.
